When agreeing to these terms and conditions, you agree and abide all the terms and conditions stated in this
Buyer expressly agrees that Seller’s Invoice and these Terms and Conditions of Sale represent the complete agreement of the parties with respect to the sale of the product(s) listed on the Invoice and no different or additional terms or conditions in Buyer’s purchase order or in any other prior or subsequent communications in any way adding to, modifying or otherwise changing these Terms and Conditions of Sale shall be binding upon Seller.
acceptance of orders
Seller may accept buyer’s offer to purchase and shall be bound to supply the applicable Goods in accordance with these terms and conditions either by execution of the acknowledgment copy of the order, or acceptable electronic transmission, delivery of the Goods to CAI or by any other statement, act or course of conduct which constitutes acceptance under applicable law.
Unless otherwise indicated on the face of the invoice, all prices are quoted on a per pound basis. Buyer is responsible for any tax or government charges imposed upon the sale or transfer of the Product. Buyer shall not have any right to set off any amounts due hereunder against any amounts which may become payable to Seller under any other agreement.
Unless otherwise agrees in writing signed by officer of Seller, all delivery dates are estimates Seller shall use its reasonable efforts to deliver all Product within the time specified; however, in no case shall Seller be liable for any expense, loss or damage whatsoever suffered by Buyer as a result of the Seller’s failure to deliver Product by the specified date.
- All deliveries require a signature. If you are not going to be in on the day of delivery, please nominate a neighbour that will be (and add that information to the 'comments' section of your order).
- Please double check the delivery address on your order confirmation!
- LemonFreshUK will send you an email when your goods are despatched advising the expected day of delivery. UKMail will send you a notification on the day of delivery advising you of your 1 hour delivery window.
- UKMail will attempt delivery 3 times. If your parcel is not delivered it will be 'returned to sender'.
- In the event of LemonFreshUK receiving your undelivered parcel, your order will be cancelled. You will be given a refund of the cost of the goods (not including delivery) minus £10 admin fee.
- You can choose to have your parcel delivered to a 'safe location' with no signature (add that information to the 'comments' section of your order). BUT... Please be aware that thefts can, and have, occurred from safe places! There is no compensation from LemonFreshUK or UKMail for such a theft.
- When delivery is charged at £2.99 the buyer accepts it will not be sent express delivery and they understand their order may take up to five working days to arrive.
MAINLAND & HIGHLANDS DELIVERY
Our standard and express service for £4.99 + £6.99 respectively is for mainland UK deliveries only. If you live in a remote area, the highlands or offshore UK (Such as Jersey) then once your order has been placed, our team will be in touch with you to discuss the final delivery surcharge, all depending on the area you live. If you are not happy with the additional delivery cost, we shall happily refund the order for you.
cancellation or modification
Cancellation of orders must be done within 12 hours of order to ensure the order has not been dispatched. If an order is cancelled a refund will not be issued until the goods have been received in the condition sent and the buyer will be responsible for return delivery cost. Orders once processed will not be modified unless management authorise the modification.
All products sold on this website include tax. We are a registered company in the UK and pay tax but are not VAT registered.
limitation of liability
We work hard to ensure our website is safe and secure. We use PayPal for safe and secure transactions. We have taken every effort to ensure a safe website and will not be responsible for malware, viruses or other malicious software harming your computer. We are not responsible for bank details and exposure to online fraud. Our website is safe, secure and we will never share your details with a third party.
As a responsible retailer, we are not a wholesaler. When you place an order with ourselves you understand and agree that the order is for personal use only and not for resale. We hold no liability for individuals or companies that resell our products.
Return of material
We do accept returns if the goods are sent back unopened and with seals intact. It is the buyers responsibility to pay postage for returns and the postage will be reimbursed as long as the products are intact, unopened and in the condition sent. For faulty goods or damaged goods we will replace them but will require the faulty goods back first. Postage is reimbursed at management discretion.
Buyer shall defend, indemnify and hold harmless Seller and its affiliated or related companies from and against any and all claims, losses, liability, damages and expenses including, but not limited to, attorneys’ fees and cost of defense arising from, related to or in any way connected with or alleged to arise from or out of any asserted deficiencies or defects in Product caused by any alteration or modification thereof by Buyer with or without Seller’s consent, or improper handling or storage by Buyer, the breach of any term or condition stated herein, Buyer’s failure to label Product or Buyer’s improper labeling of Product regardless of whether the labeling was done with or without the advice of Seller, or any act or omission of Buyer including any Claims for or resulting from any injury to person (including death) or damage to property or for economic loss, several or comparative negligence, breach of agreement, breach of warranty or other breach of duty of or by Indemnitee or as a result of Indemnitee’s strict or other product liability. The foregoing indemnification shall not be construed to eliminate or in any way reduce any other indemnification or right which Indemnitee has by law.
We accept PayPal for payments. In the event of dispute, the buyer is to contact us by email in the first case of dispute and not just open a payment dispute in PayPal. In the event a dispute is opened without reasonable consultation with our company will result in the dispute being awarded in our companies favour.
